Terms and Conditions

1.
Acceptance/receipt of the Estimate means you are aware of and accept the terms and conditions set out below (“Terms and Conditions”). These Terms and Conditions together with the information on the Estimate shall form the contract between us for the engagement by you of the services of the Artist. In the event of any inconsistency between these Terms and Conditions and any contained in your purchase order these Terms and Conditions shall apply. For the purpose of these Terms and Conditions any word with capital letters shall have the meaning given to it in these Terms and Conditions or the Estimate, as applicable.

One hundred percent (100%) of the Artists Fees and the Estimated Production Costs set out in the Estimate are to be paid plus VAT (where applicable) to us within thirty (30) days of receipt of our invoice.

Any budgeted expenses and/or costs in excess of the Estimated Production Costs set out in the Estimate reasonably incurred by us on your behalf during the Project will be separately invoiced and are payable plus VAT (where applicable) within thirty (30) days of receipt of our invoice. We will use our reasonable endeavours to obtain your prior approval in respect of us incurring additional expenses/costs.

Receipts will only be supplied if we have specifically agreed in writing to a request for this prior to the booking of the Project.

Should you wish us and/or the Artist to carry out any additional or extra work in connection with the Project which is not set out in the Estimate, we reserve the right to vary any estimate previously given to you. Any subsequent variation to the Estimate or these Terms and Conditions shall only be effective if confirmed in writing in a separate addendum signed by or on behalf of both of us and you. You further acknowledge that unless a separate addendum is so signed we and/or the Artist shall not be obliged to carry out any additional or extra work in connection with the Project.

Unless a Rejection/Kill Fee has been specifically agreed in writing between us in advance and set out in the Estimate there is no right for you and/or the Client to reject the work done on the basis of style, composition, artistic merit or commerciality. For the purpose of this paragraph, a “Rejection/ Kill Fee” shall mean a fee payable in return for you and/or the Client having the right to reject the input of our Artist on artistic or commercial as opposed to technical grounds.

In the event of a cancellation of the Project requested by you and/or the Client and/or caused by your and/or the Client’s default and/or neglect you agree to pay us the following percentage of Artist Fees and Estimated Production Costs. Cancellation of Project within fourteen (14) days of the Project Date: one hundred percent (100%) of Artist Fees and any Estimated Production Costs incurred by us and/or which we are committed to pay. Cancellation of the Project more than fourteen (14) days prior to the Project Date: twenty-five percent (25%) of Artist Fees plus any Estimated Production Costs incurred by us and/or which we are committed to pay. You shall pay to us the sums due arising from such cancellation within five (5) days of our notifying you in writing of them and issuing an invoice.

Further, if you postpone the project either the Artist or any third party connected to the project and whom we have confirmed upon your instruction who invoices us for such postponement or for loss of work turned away will have to be paid and we will, in turn, bill you for such costs.

 

 

9.

Apart from where otherwise stated in the Estimate where we may provide that a percentage of the Estimated Production Costs are paid prior to commencement of the Project, (described in the Estimate as an Advance), payment of our advance invoices must be made in full prior to the Project starting. We reserve the right to charge interest if the invoice is unpaid after thirty (30) days we reserve the right to charge Late Payment charges.
